Please be advised that your use of other services provided by Insight, for example, use of Insight websites or other cable services, may subject you to additional privacy provisions. You should also be aware that our Insight Broadband Internet Service may allow you to view third party content or interact with third parties that are independent of Insight. By using these third party services, you may enable these third parties to obtain your personally identifiable information. You must review the privacy policies, if any, provided by these third parties. The practices described in this privacy policy do not apply to such third parties, and Insight is not responsible or liable if these third parties fail to follow their posted policies.
In this privacy policy, we use the Terms "Insight," "we," "us," or "our" to include Insight Midwest, L.P. and the Insight operating company that owns, operates or manages the cable system and Insight Broadband Internet Service in your area.
Personally Identifiable Information
"Personally identifiable information" is information that, when associated with an individual, identifies that individual. It does not include aggregate data that does not identify a particular person. The types of information that may constitute personally identifiable information include:
Personal registration and account information, including your name, addresses, such as service, billing and e-mail address, telephone numbers, home ownership or rental information, social security number, driver's license number, credit card or bank account information, billing, payment and credit records, service maintenance and repair records, service subscription and system transaction information, customer correspondence, marketing information, customer complaint and service history, records of deposits, damages and/or violations or alleged violations of the terms, conditions and policies that govern your use of the Insight Broadband Internet Service;
Account usage information, including the services you subscribe to, service preferences and settings you indicate through your voluntary interaction with the system and how often and long you access and use the Insight Broadband Internet Service when such information is accompanied by information that individually identifies you, certain transactions you make through the Insight Broadband Internet Service, and the number and name of e-mail addresses or accounts set up through the Insight Broadband Internet Service;
Technical information, including the types and number of devices you use to connect directly or indirectly to the system (e.g., converters, cable modems, or other equipment); information about your device hardware or software; the location, configuration, delivery and routing of these devices and our services to you; and individual maintenance and repair records for the devices you use for the Insight Broadband Internet Service; and
Other information accompanied by individual information that identifies you, including electronic communications, content or other transmissions, research records containing information obtained through voluntary customer interviews or surveys, information provided to Insight from receipt of cable or other services, publicly available information, or other information collected to render our Insight Broadband Internet Service to you.
Some information above may be separated or segregated from identifying information where it is no longer considered personally identifiable information and becomes aggregate, non-personal information. Aggregate information may be collected, used or disclosed for broader purposes than provided in this policy.
Collection and Use of Personally Identifiable Information
Insight collects personally identifiable information when you voluntarily provide this information to us, when you have consented to the collection such information, or if the collection is otherwise authorized by law.
Applicable law authorizes us to use our cable system to collect personally identifiable information as necessary in order to render our Insight Broadband Internet Service and service features and to detect unauthorized reception and use of our Insight Broadband Internet Service and service features. We can only use our cable system to collect personally identifiable information for these purposes unless we obtain your prior written or electronic consent.
Insight may collect and use personally identifiable information about you or users of your Insight Broadband Internet Service account, as provided for in applicable law, in order to:
Operate and provide the Insight Broadband Internet Service, including to establish, install, support, upgrade and enhance our services to you; confirm receipt of requested services and service changes; establish secondary accounts on the service; transmit your voluntary communications or content over the system, such as e-mails, video-mail, instant messages and other voluntary submissions or preferences; and to manage our service network;
Provide account customer service, including to invoice, bill and manage your account; provide technical and software support; anticipate, identify and resolve problems with the service; communicate with you about service issues or announcements, service changes, enhanced features, improvements, special offers or promotions, and new product or service offerings we think may be of interest to you; and to survey customers about preferences and interests;
Protect our Insight Broadband Internet Service and customers, including to protect the security of our facilities, equipment, services and/or customers; investigate and detect unauthorized reception, use or abuse of our services; and prevent potentially unlawful activity or activity that threatens our network or otherwise violates the Insight Broadband Internet Service Agreement; and
Ensure compliance with applicable laws and our terms, including customer compliance with the terms, conditions and policies governing the Insight Broadband Internet Service; and maintaining our business, tax, and accounting records.
Insight may use your personally identifiable information, in conjunction with information available from other sources, to market new services or products to you or that may enhance or optimize your service features. In order to protect the security of the Insight Broadband Internet Service and our network, we may operate certain network protection features to scan proper customer use of the Insight Broadband Internet Service and to detect unauthorized access or activity. We will not collect additional personally identifiable information while utilizing such network protection features unless the collection is authorized under federal law.
We may also combine personally identifiable information we have obtained in accordance with this policy with other publicly available information (such as census and household information) or information obtained from our affiliated entities or other third parties. We may use this information to create an enhanced customer database, to research and/or update our service features, or we may segment personally identifiable information to create separate customer lists or to separate aggregate information. Aggregate information lists that we may collect or create do not identify individual customers.
In addition, Insight may collect information about Insight Broadband Internet Service usage in aggregate form, such as the number of connections to a specific service feature at a specific time of day, to review service offerings and provide the most desired services to customers. We do not collect personally identifiable information with this aggregate data.
When you access Insight Web sites, such as Insightbb.com or Insight-com.com, Insight, its affiliates and advertisers may use various kinds of software devices to collect and use information to allow participation in certain Web site activities, features or site services. Devices used to collect this information may include cookies, gifs and other tracking devices. These devices generally collect non-personal information and are used to facilitate and enhance navigation and service offerings. Personally identifiable information may be collected with these devices when you voluntarily provide or enter such information online. Disclosure of Personally Identifiable Information
We disclose personally identifiable information about you to others if you provide written or electronic consent in advance or it is permitted by law. Specifically, federal law allows us to disclose personally identifiable information to third parties when (a) it is necessary to render, or conduct a legitimate business activity related to, our services provided to you; (b) when disclosure is required or authorized by court order or other legal process; or (c) disclosure is of the names and addresses of customers for mailing lists or other purposes; subject to a customers right to limit this disclosure.
Disclosures necessary to render or conduct a legitimate business activity include, but are not limited to, disclosures to connect, utilize, operate and update your Insight Broadband Internet Service; fulfill requested transactions; personalize your online experience; properly service, maintain and bill your account; help research, develop and offer new and enhanced services provided by Insight and/or its affiliates; prevent fraud, other unlawful activity or to investigate and enforce violations of the Insight Broadband Internet Service policies; protect our customers, employees or property in emergency situations; enforce or protect our rights in court or elsewhere; or disclosures pursuant to a transfer in ownership of all or a part of the Insight Broadband Internet Service.
Insight discloses personally identifiable information pursuant to legal requirements found in the Cable Communications Policy Act of 1984 ("Cable Act"), the Electronic Communications Privacy Act ("ECPA"), the Digital Millennium Copyright ("DMCA") and other applicable laws. We will disclose such information pursuant to a warrant, court order, administrative subpoena, other legal process or voluntarily if we reasonably believe that an emergency involving immediate danger of death or serious injury to any person justifies disclosure of the information or if such disclosure is otherwise required or authorized under applicable law. These disclosures may be provided to representatives or agents of government or other authorized persons. If a government entity seeks to obtain certain personally identifiable information pursuant to a court order, the Cable Act provides that the affected customer be afforded the opportunity to appear and contest such disclosure in a court proceeding relative to such order.
A private party may also use a properly authorized subpoena under the DMCA to require our disclosure of a customer's personally identifiable information when the party believes the customer has infringed on the copyright of such party.
The ECPA also authorizes, and other laws may require, the disclosure of customer personally identifiable information, including content or other communications contained in e-mails or available via our Insight Broadband Internet Service, if we become aware of evidence of child pornography, we inadvertently obtain content or communications and it appears to pertain to the commission of a crime, or disclosure to law enforcement if we believe there is an emergency involving death or serious injury that requires disclosure. Disclosure of content and other communications is also permitted for other circumstances, including to an addressee or intended recipient (or his or her agent) of communications sent by you; when it is necessarily incident to providing our Insight Broadband Internet Service or to protect our rights or property; or to others with your consent or the consent of the addressee or intended recipient of such communications.
Unless you object, the law allows us to disclose your name and address for mailing lists or other purposes. We may disclose this limited information to charities, marketing organizations and other businesses or third parties. Such disclosures may not be in a form that reveals the extent of any viewing or other use you make of the services we provide, nor may it disclose the nature of any transaction you make over the cable system. If you do not wish to have your name and address disclosed in this limited manner, or if you wish to limit the circumstances in which we will disclose it, please obtain, fill out, and return a
"Nondisclosure of Name and Address" form from your local Insight business office.
Parties that may have authorized access to your personally identifiable information for the above purposes include, but may not be limited to, our employees and sales agents; businesses or persons that provide services to Insight, such as billing and collection services, credit reporting agencies, installation, repair and customer assistance subcontractors or agents, sales representatives, attorneys, consultants, accountants, software vendors, service suppliers, auditors of service and marketers of Insight Broadband Internet Service products and services; strategic partners offering or providing products or services jointly or on behalf of Insight; entities affiliated with us through common ownership or control; consumer research entities; merchants or other third parties from whom you make purchases or other transaction requests; a purchasing entity and related third parties if we sell or transfer ownership or enter into an agreement contemplating a sale or transfer; authorized representatives or agents of government; and/or other authorized third parties if we are involved in bankruptcy proceedings or if we are required or authorized to make disclosures to such other third parties under applicable law.
The frequency of disclosures to these parties varies according to business or legal needs. For example, information for billing purposes is generally provided on a monthly basis. Information for other purposes may be provided on a daily basis.
If federal law requires, we will provide you notice of a disclosure of your personally identifiable information as identified above.
Security
Insight has implemented security features, such as routers, firewalls and encryption technology, and policy guidelines to safeguard the privacy of your personally identifiable information from unauthorized access. We will continue to enhance our security procedures as new technology becomes available.
Despite these measures, we do not guarantee the security of information stored in our databases or that unauthorized parties will not intercept information you send or receive over the Internet. As a shared resource, the Internet subjects our services and you to the risk of unauthorized access to files and data, even when security measures are implemented. These risks are not unique to our service, but exist whether you access the Internet through other providers or technologies. If you use the Insight Broadband Internet Service or the Internet, you do so at your own risk, and to protect your information from unauthorized access, you should implement individual hardware or software security protections on your electronic devices.
Access to Personally Identifiable Information
As a customer, you may review personally identifiable information held by us that pertains to you when such information is maintained in reasonably retrievable form and if you give us a reasonable period of time to prepare the information for review. (Preparation is sometimes necessary to avoid disclosure of information relating to other customers.) If you wish to review your personally identifiable information, please notify us by clicking

We will then gather and prepare your personally identifiable information and arrange a time for you to come in to your local Insight business office during normal business hours to examine this information. You may request correction of any errors in personally identifiable information that we collect or maintain pertaining to you. Upon such request, we may require that you submit a reasonable showing that such personally identifiable information we have collected or maintained about you is inaccurate. We reserve the right to determine, in our sole discretion, whether or not to make changes to a customer's personally identifiable information that we maintain in our business records. We also reserve the right to charge for copies of documents you request.
Length of Personally Identifiable Information Retention
Insight retains personally identifiable information for as long as it is necessary for the purpose for which it was collected, to comply with laws governing our business, including tax and accounting laws, or to satisfy pending requests or orders for access by subscribers, the government or pursuant to court order or other lawful process. These retention requirements apply while you are an Insight Broadband Internet Service customer and may continue for a period of time after you are no longer a customer. For example, to comply with tax or other accounting laws, this means we may retain personally identifiable information for seven years or longer. When information is no longer necessary for these purposes, we destroy it.
Changes to these Privacy Practices
We will review our privacy practices as we deem appropriate and/or when we update or change our Insight Broadband Internet Service. We will inform you of any changes that we make to this policy by posting changes in a revised privacy policy that will be made available to you through our Insight Broadband Internet Service, e-mail or postal mail. Use of the Insight Broadband Internet Service following revisions to this privacy policy constitutes your acceptance of the revised privacy provisions.
Your Rights Under Federal Law
If you believe that we have violated the Cable Act's limitations on the collection, disclosure and retention of personally identifiable information, you may have the right to bring an action for damages in Federal District Court. In the Insight Broadband Internet Service Agreement, you have agreed that, to the extent permitted by law, certain claims you may have against us, including damage amounts, will be limited. If you do not agree with such limitations, you have the right to cancel your Insight Broadband Internet Service.
Privacy Protection for Children
Insight does not knowingly collect personally identifiable information from children under thirteen years of age to connect and provide the Insight Broadband Internet Service. In addition, the Insight Broadband Internet Service is not directed to children under the age of thirteen. If, as a part of future service offerings, we decide to request personally identifiable information from children under thirteen, we will provide notice of any additional privacy protections and will require verifiable parental consent before we collect this information, except in circumstances authorized by law and by the Children's Online Privacy Protection Act.
Insight encourages parents and guardians to take an active role to protect the privacy and security of their children. Insight supports the development of technologies that help parents and guardians control the collection and use of personal information from children who use online services in their households.
